Accountabilities
Concession Compliance
- Monitor compliance with the railroad regulatory service law,
its regulations, and any commitments and obligations derived from the concession title.
- Provide legal advice on railroad regulatory issues, issues related to the concession, as well as applicable laws, regulations, and rules.
- File reports and official responses to SCT and the Agency.
- Deal with the verifications and inspections performed by the SICT and the ARTF.
- File official requirements and responses with the SICT and the ARTF.
- Keep a record of the Mexican Railway Registry.
- Perform internal reviews- audits.
- Ensure compliance with terminal obligations and permits.
- Monitor compliance with the Telecommunications law.
- Monitor compliance with Data Protection Privacy Law and Transparency.
Litigation
- Administrative, commercial, civil liability, tax, customs, agrarian, labor, and criminal litigation.
- Responsible for receiving, studying, and analyzing all legal actions, claims, and lawsuits filed by, or against KCSM.
- Coordinate and supervise various outside law firms handling litigation and participate in forming strategies to safeguard KCSM’s interest in all litigation cases.
- Negotiate out-of-court settlements of debts arising from railroad traffic, demurrage, miscellaneous services, and damages to railroad equipment.
- Exemplify CPKC Vision, Values, and Culture in interactions with coworkers, business partners, customers, and stakeholders.
Ideal Candidate Qualifications
Required
- Bachelor's Degree in law
- Regulatory and litigation law experience
- Compliance manager experience (due diligence)
- Professional experience of at least 15 years
- Fluent in English
